Cowboy Way Channel National Day Of The Cowboy Giveaway Official Rules
SWEEPSTAKES DESCRIPTION: To enter Cowboy Way Channel’s National Day Of The Cowboy Giveaway (hereinafter, “Sweepstakes”), follow all instructions on @CowboyWayChannel’s Instagram posts regarding the Sweepstakes (posted on July 24th, 2024 at 12:00 PM ET). Winners of the Sweepstakes will be selected by random drawing. Only completed comments will be entered into the drawing. YOU MUST ENTER THE DRAWING BY ELECTRONIC REGISTRATION; NO US MAIL OR FAX ENTRIES PERMITTED. Sponsor is not responsible for entries that are lost, late, destroyed, forged, tampered with, incomprehensible, misdirected, illegible, incomplete, or otherwise not in compliance with these Official Rules. All information submitted by the entrant becomes the sole property of Cowboy Way Channel, a Delaware entity located at 3000 WorldReach Drive, Indian Land, SC 29707 (hereinafter, “Sponsor”). Cowboy Way Channel is the sole sponsor of this Promotion, and this Promotion is in no way sponsored, endorsed, administered by, or associated with any social media platform or any other third party, including, without limitation, Facebook, Twitter, Instagram, or Snapchat.
ELIGIBILITY REQUIREMENTS: To be eligible, all entrants must meet the following requirements: 1) provide all information requested in the online entry form; 2) abide fully with these Official Rules, 3) be at least eighteen (18) years of age; and 4) be a resident of one of the 50 United States or the District of Columbia (excluding residents of Guam, the U.S. Virgin Islands, Puerto Rico, and other U.S. territories and possessions and where prohibited by law). ONLY ENTRANTS LOGGING ONTO THE INTERNET FROM WITHIN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ARE ELIGIBLE TO ENTER THE SWEEPSTAKES. YOU MAY NOT PARTICIPATE IF YOU ARE NOT A LEGAL U.S. RESIDENT AND PHYSICALLY LOCATED WITHIN THE UNITED STATES AT THE TIME OF ENTRY. The following persons are not eligible to enter the Sweepstakes: (a) employees of Sponsor, its affiliates, subsidiaries, officers or directors, (b) immediate family members and persons living in the same household as the persons identified in (a) above, and (c) residents of Guam, the U.S. Virgin Islands, Puerto Rico, and other U.S. territories and possessions.
NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN THE SWEEPSTAKES. VOID WHERE PROHIBITED BY LAW.
TIMING: The Sweepstakes begins on July 24th, 2024 at 12:00 PM ET and ends on July 26th at 12:00 PM ET. Unlimited entries per person. Unlimited entries per person. (the “Entry Period”). The sponsor’s computer is the official timekeeping device for this Promotion.
ENTRY: To enter online, visit https://www.instagram.com/cowboywaychannel/ and complete the instructions on Cowboy Way Channel’s post regarding the Sweepstakes (July 24th, 2024 at 12:00 PM ET). Entrant will receive 1 entry per comment into the Sweepstakes upon successful completion and submission of the entry rules on social. Sponsors reserve the right to contact entrants whose username is submitted as part of this Sweepstakes. Entrants may then choose to opt-out of future notifications. ENTRANT MUST ENTER THE DRAWING BY ELECTRONIC REGISTRATION; NO US MAIL OR FAX ENTRIES PERMITTED.
Use of any automated system to participate is prohibited and will result in disqualification. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries, which will be disqualified. In the event of a dispute as to any entry, the authorized account holder of the username used in connection with the entry will be deemed to be the entrant. The “authorized account holder” is the natural person assigned a username address by an Internet access provider, online service provider, or other organization responsible for assigning username addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. All entries become the sole and exclusive property of the Sponsor and will not be returned.
PRIZE:
One winner will receive a prize consisting of:
(1) 6th Generation iPad Mini
(1) The Warrant DVD
(1) Visa Gift Card
The total Approximate Retail Value (“ARV”) of the prize is $600.
Prizes are non-transferable, with no cash redemption or equivalent. Sponsor or its authorized agent shall deliver the respective prizes within sixty (60) days of the selection date. Sponsor reserves the right to substitute any listed prize for one of equal or greater value for any reason. All federal, state, and local income taxes, insurance, licensing, registration and title fees connected to the prize are the sole responsibility of the winners. It is the responsibility of the entrant to claim the value in their personal taxes. All federal, state and local laws and regulations apply.
RANDOM DRAWING: The winners will be selected by random drawing on or about April 1st at 10:00 AM ET from all completed entries submitted during the Entry Period. Odds of winning vary by participation and the number of eligible entries received.
LIST OF WINNERS: For a list of all winners, available after August 19th, 2024, mail a self-addressed, stamped envelope to: Digital Content and Social Media, “Cowboy Way Channel National Day of The Cowboy Giveaway List,” 3000 WorldReach Drive, Indian Land, South Carolina 29707.
Entrants are responsible for providing valid username handles and checking their respective private message folders for notifications related to Sweepstakes. Sponsor shall have no liability for any winner notification intercepted or not received by a potential winner for any reason or received by a potential winner after the expiration of any applicable notification/response deadline identified herein. If a potential winner does not respond within 24 hours of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected from among all remaining eligible entries. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified, and an alternate winner may be selected from among all remaining eligible entries. If the first potential winner is ineligible, disqualified, or forfeits the prize for any reason, Sponsor, at its sole discretion, may successively attempt to contact up to five (5) potential winners of a prize, in accordance with such procedure, and if there is still no confirmed winner of the prize in question after such attempts have been made, such prize may go unawarded.
SUBMITTED MATERIALS AND PERSONAL INFORMATION: The sponsor will be collecting personal data about entrants in accordance with its Privacy Policy. By participating in the Sweepstakes, you hereby agree to the Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy. All materials and information submitted in connection with the Sweepstakes become the property of the Sponsor. Sponsor reserves the right to edit, publish, use, modify or adapt the materials and information submitted. To the extent permitted by law, participation in the Sweepstakes constitutes permission to use the winner’s name, biographical data, photograph, hometown, home state, testimonial or other likeness and/or prize information or personal exposition for promotional, advertising and/or publicity purposes by Sponsor or its designee(s), without further compensation to or approval by the winner.
CONDITIONS OF PARTICIPATION: Upon Sponsor’s request, winners shall provide, complete, sign, and return the Affidavit of Eligibility and Release (“Affidavit and Release”). If the winner does not complete, sign and return such Affidavit and Release within ten (10) business days of Sponsor’s written request or otherwise does not comply with these Official Rules, that person will be disqualified and Sponsor will draw for another winner. Neither Sponsor nor its agents shall be responsible for (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) a potential winner’s failure to maintain or check a submitted social account, or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If, for any reason, the Sweepstakes is not capable of running as planned, including without limitation infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor, which corrupt or affect the operation, administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor may, in its sole discretion, void any suspect entries and (a) cancel or terminate the Sweepstakes (or any portion thereof); (b) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (c) award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
LIMITATION OF LIABILITY: BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT NEITHER SPONSOR NOR ITS RESPECTIVE PARENT, AFFILIATES, SUBSIDIARIES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLIC RELATIONS, PROMOTIONAL, FULFILLMENT AND MARKETING, WEB SITE PROVIDERS, WEB MASTERS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (THE “RELEASED ENTITIES”), WILL HAVE ANY LIABILITY WHATSOEVER AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING (BUT NOT LIMITED TO) PERSONAL INJURY (INCLUDING DEATH) OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF ANY PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY SWEEPSTAKES RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED ENTITIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO CIRCUMSTANCES BEYOND SPONSOR’S CONTROL, INCLUDING WITHOUT LIMITATION ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM. BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE THAT THE RELEASED ENTITIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS, INCLUDING DEATH, OR TO PROPERTY FOR ANY REASON, INCLUDING WITHOUT LIMITATION ARISING OUT OF ACCESS TO AND USE OF THE WEBSITE, THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE WEB SITE AND ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of North Carolina, without regard to its conflict of law principles, and exclusive jurisdiction for all claims arising in connection with the Sweepstakes shall reside in a court located in Charlotte, North Carolina.
BY ENTERING, EACH ENTRANT CONFIRMS HAVING READ THESE OFFICIAL RULES AND AGREES THAT S/HE UNDERSTANDS AND WILL COMPLY WITH THEM.
